How Texas online notarization works for signers who are away

Signing Closing Papers for a Sienna Home From Outside Texas

Updated October 2026

Can I sign the notarized closing documents for a home in Sienna without being in Texas?

Yes: in October 2026, Texas lets an online notary notarize your signature by video wherever you are, as long as the notary is physically in Texas.

Where must the notary and the signer each be for a Texas online notarization?

The Texas Secretary of State's guidance for online notaries sets the rule by where each person is. A Texas online notary must be physically located within the boundaries of Texas at the time of notarization. The same guidance says the signing party may be located anywhere.

The Secretary of State's answers for notaries define the act. Online notarization is performed by an online notary through two-way video and audio conference technology that meets the office's standards. Those standards include credential analysis and identity proofing. An electronic notarization is a different act, and the office says it cannot be performed through video or audio conference.

The Texas Real Estate Research Center's article says an online notary may accept an electronic signature from a signer in Texas or out of state.

How does remote signing fit a fixed move date in Sienna?

Count back from the day you need the keys. Once a seller accepts, the contract runs through the option period, the appraisal, the title work and closing.

Ask the title company which way of signing it accepts before you sign the contract. Its answer decides whether you travel to Fort Bend County for closing or sign from where you live now.

Request the association's resale certificate and current budget before the option period ends, along with the section's deed restrictions.

Questions & answers

Sienna questions, answered

How much does an online notary charge to notarize my Sienna closing papers?

The Texas Secretary of State's guidance for online notaries, dated October 2026, lets an online notary charge up to $25 for each notarization performed. That amount comes on top of regular notary charges, so the total depends on how many signatures in the file need a notary. Ask the title company handling your Sienna closing how many notarized documents it expects and who covers the notary's fee.

The $25 in the Secretary of State's guidance is a ceiling for each notarization, added to the usual notary charge. Get the expected fee in writing along with the other closing figures, so a remote signing adds no unexpected cost on closing day.

Is the video of my online signing kept, and who can see it?

Yes, it is kept. The Texas Secretary of State's record-keeping rules for online notaries require the notary to keep the original recording and a back-up for five years following the date of the notarization. Those rules say the recording of the audio-visual conference should also capture the notarial act itself. The office adds that the records of a notarization are public information, and that includes the audio-visual recording.

Plan the session with that record in mind. Sign from a quiet room with your identification within reach, since the act itself is on the recording. Keep the screen limited to the closing papers, because the recording is a public record for five years after the notarization date.

Are Texas real estate contracts and closing documents signed electronically now?

Many of them are. The Texas Real Estate Research Center's 2018 article on the online notarization law says many contracts, addenda and disclosures are signed electronically, as are many lending and closing documents. The Texas Real Estate Research Center also notes that some counties accept electronic recordings of recordable documents. Ask the title company on your Sienna purchase which papers it takes electronically and how it records in Fort Bend County.

Settle the method early. A buyer who plans to sign from another state needs the title company's answer before the closing date is set around a move, since that answer decides whether a trip to Fort Bend County belongs on the calendar.

Is the pandemic-era rule on notary appearances still in effect in Texas?

No. The Texas Secretary of State's answers for notaries say the Governor's temporary suspension of section 121.006(c)(1) of the Texas Civil Practice & Remedies Code terminated effective 12:01 a.m. on September 1, 2021. For a signer outside Texas, the route the Secretary of State describes today is an online notarization performed by a Texas online notary. Plan a remote Sienna closing around those current rules.

Older guidance from the pandemic years may still describe the suspension as if it applied. Check the date on any advice about notary appearances before you build a closing schedule on it, and ask the title company which method it will use for your file.

What ID will I need for an online notary if I sign from another state?

Bring government-issued identification that carries your photograph and your signature. The Texas Real Estate Research Center says signers the notary does not know personally must present that kind of identification to an online notary, as they would to a regular notary. The Texas Real Estate Research Center gives a driver's license or a passport as examples. Have it ready before the video session on your Sienna closing begins.

Check that the identification is current well before closing week. A move often packs important papers into boxes, so keep the license or passport with you until every closing document is signed.
